Welcome to the Bafumbira Dating Platform on bafumbira.com. These Terms and Conditions (“Terms”) govern your access to and use of the Bafumbira Dating Platform (“the Platform”, “we”, “us”, or “our”).

By creating an account, submitting a dating profile, browsing profiles, communicating with other members, or otherwise using the Platform, you confirm that you have read, understood, and agreed to these Terms.

If you do not agree with these Terms, please do not use the Platform.

1. PURPOSE OF THE PLATFORM

The Bafumbira Dating Platform is a digital platform designed to help Bafumbira people and people interested in forming meaningful relationships with Bafumbira people connect, communicate, and potentially develop friendships, romantic relationships, partnerships, or marriages.

The Platform is intended to provide a structured online environment for people to discover and interact with potential partners.

The Platform is not a WhatsApp group, social-media group, matchmaking guarantee, marriage agency, or dating guarantee service.

The Platform simply provides a digital environment in which members can discover and communicate with other members.

2. ELIGIBILITY

You may use the Bafumbira Dating Platform only if:

You are 18 years of age or older.
You have the legal capacity to enter into these Terms.
The information you provide is truthful and reasonably accurate.
You are not prohibited by applicable law from using an online dating service.
You agree to comply with these Terms and all applicable laws.

We reserve the right to request reasonable information necessary to establish eligibility or to investigate suspected misuse of the Platform.

3. ACCOUNT REGISTRATION

To use certain features of the Platform, you may be required to create an account.

You agree to:

Use a profile to promote fraudulent activities;
Publish sexually explicit, abusive, hateful, or illegal material.

We may remove or restrict profiles that violate these Terms.

5. CULTURAL IDENTITY AND BAFUMBIRA CONNECTION

The Platform has a particular cultural focus on Bafumbira people and the Bafumbira community.

Members may voluntarily identify their relationship to Bafumbira culture, including their family, community, language, heritage, or clan.

However, members should not use cultural identity, clan affiliation, nationality, geographical origin, religion, family background, or any other characteristic as a basis for harassment, discrimination, intimidation, exclusion, or abuse.

Information about clan, family, cultural background, or ancestry should be provided voluntarily and truthfully.

6. COMMUNICATION BETWEEN MEMBERS

The Platform may allow members to communicate with one another through available features.

Members are solely responsible for their interactions with other members.

You agree to communicate respectfully and must not:

Harass or threaten another member;
Send unwanted sexual content;
Send abusive or degrading messages;
Engage in hate speech;
Extort or blackmail another member;
Repeatedly contact someone who has indicated that they do not wish to communicate;
Attempt to obtain another person’s passwords, financial information, or confidential information;
Use the Platform to facilitate illegal activities.

A member has the right to stop communicating with another member at any time.

If someone asks you to stop contacting them, you should respect that request.

7. NO GUARANTEE OF A RELATIONSHIP

The Bafumbira Dating Platform does not guarantee that you will:

Find a romantic partner;
Find a spouse;
Receive messages or matches;
Meet someone compatible with you;
Develop a successful relationship;
Get married;
Have a positive experience with another member.

The Platform provides an opportunity for people to connect. The outcome of those interactions depends entirely on the individuals involved.

8. MEMBER SAFETY

Online dating involves risks. Members should exercise reasonable caution when communicating with people they have not met in person.

We strongly recommend that members:

Take time to know someone before meeting them;
Use the Platform’s communication features before sharing personal contact information;
Never send money to someone merely because you met them through the Platform;
Be cautious of requests involving loans, investments, emergencies, medical expenses, travel expenses, or financial assistance;
Avoid sharing passwords, PINs, banking information, or other sensitive credentials;
Meet new people in safe, public places;
Inform a trusted person before meeting someone for the first time;
Trust their instincts and discontinue communication if something feels wrong.

Never assume that a profile has been verified simply because it appears on the Platform.

9. FRAUD, SCAMS AND FINANCIAL SOLICITATION

The use of the Platform for fraud, scams, financial exploitation, or deception is strictly prohibited.

Members must not use the Platform to:

Promote fraudulent businesses;
Obtain money through false emergencies;

If you suspect that another member is attempting to defraud you, discontinue communication and report the account to the Platform.

Where appropriate and legally permitted, serious cases may be referred to relevant authorities.

10. PROHIBITED CONTENT

You must not upload, publish, transmit, or distribute content that:

Is unlawful;
Promotes violence or criminal activity;
Contains threats;
Constitutes harassment or bullying;
Is defamatory or deliberately misleading;
Contains sexually explicit material;
Exploits or sexualizes minors;
Promotes discrimination or hatred;
Infringes another person’s intellectual-property rights;
Contains malware or malicious code;
Promotes scams or fraudulent schemes;

Any content involving the sexual exploitation of children is strictly prohibited and may be reported to appropriate authorities.

11. RESPECT AND NON-DISCRIMINATION

Members are expected to treat one another with dignity and respect.

We do not permit harassment based on characteristics such as:

Disability;
Nationality;

Clan;
Social or economic status;
Religion;
Physical appearance;
Place of origin.

Having preferences regarding compatibility does not give any member permission to insult, humiliate, threaten, or abuse another member.

12. PHOTOGRAPHS AND USER CONTENT

By uploading photographs, descriptions, messages, or other material to the Platform (“User Content”), you confirm that:

You have the right to submit the material.
The material does not knowingly violate another person’s rights.
The material complies with these Terms.

You retain ownership of content that you lawfully own.

However, by submitting User Content, you grant the Platform a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, format, and technically process that content as reasonably necessary to operate, maintain, promote, and improve the Platform.

We may remove content that violates these Terms or applicable law.

13. PRIVACY

14. PERSONAL INFORMATION OF OTHER MEMBERS

You must not collect, publish, sell, distribute, or misuse another member’s personal information without lawful authorization.

You must not:

Publish another person’s phone number without permission;
Publish private photographs without permission;
Share private conversations publicly to embarrass another member;
Publish someone’s home address;
Use another member’s information for harassment or intimidation;
Sell or distribute member information.

Any misuse of personal information may result in suspension or termination of your account and may also have legal consequences.

15. REPORTING AND BLOCKING

Members are encouraged to report accounts or content that they believe violate these Terms.

Reports may include:

Fake profiles;
Scams;
Harassment;
Threats;
Sexual misconduct;
Impersonation;
Fraud;
Inappropriate content;
Other violations of these Terms.

Where Platform functionality permits, members may also block other members.

We may investigate reports and take appropriate action, including removing content, restricting accounts, suspending accounts, or permanently terminating accounts.

We do not guarantee that every report will result in a particular action.

16. MODERATION

We reserve the right, but do not assume an obligation, to moderate activity on the Platform.

Termination of an account does not necessarily eliminate obligations or liabilities that arose before termination.

18. PLATFORM AVAILABILITY

Affected by technical problems;

22. DISCLAIMER

We do not guarantee the identity, character, intentions, age, relationship status, employment, financial position, education, cultural background, or other claims made by individual members unless a particular attribute is expressly identified as verified by the Platform.

Members are responsible for conducting their own reasonable due diligence.

We do not endorse or guarantee any individual member or relationship formed through the Platform.

23. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Bafumbira Beza, Miklah Life, and persons involved in operating the Platform shall not be responsible for losses, damages, injuries, disputes, fraud, emotional distress, or other consequences arising from interactions between members.

This includes, where legally permissible, consequences arising from:

Online communication;
Offline meetings;
Romantic relationships;
Financial transactions between members;
False information provided by members;
Fraudulent conduct by members;
Personal disputes between members;
Misuse of information by members.

Nothing in these Terms is intended to exclude liability that cannot lawfully be excluded under applicable law.

24. INDEMNIFICATION

To the extent permitted by law, you agree to be responsible for claims, losses, damages, or expenses arising from your:

Violation of these Terms;
Misuse of the Platform;
Violation of another person’s rights;
Fraudulent or unlawful conduct;
User Content;
Interactions with other members.

25. CHANGES TO THESE TERMS

We may update these Terms from time to time.

When changes are made, the updated version will be published on the Platform together with an updated effective date.

Your continued use of the Platform after updated Terms become effective constitutes acceptance of the revised Terms.

26. GOVERNING LAW

These Terms shall be interpreted in accordance with the laws applicable in Uganda, unless applicable law requires otherwise.
